USTR Announces Exclusion Process for Tariffs on Chinese Goods, Including Lithium-ion Batteries

The U.S. Trade Representative (USTR) formally announced the opening of a process to request exclusions from tariffs on Chinese goods in List 4 of the Sec. 301 trade case—a list that includes lithium-ion batteries. Starting October 31, 2019, USTR will open a web portal for submitting exclusion requests that will remain open until January 31, 2020. Note that any stakeholder may reply to specific exclusion requests with 14 days of its submittal. ESA encourages concerned members to file requests with USTR in a timely manner, and ESA will work with affected industry members to submit an industry-wide exclusion request as appropriate, in line with our prior comments.
