ESA Motions to Intervene in DC Circuit Review of Order 841

Today ESA filed a motion with the U.S. Court of Appeals for the District of Columbia to intervene in consolidated cases 19-1142 & 19-1147 in support of FERC’s authority regarding Order 841. ESA intends to provide an amicus brief in support of the Order, responding to theĀ petitionĀ for review by NARUC and other parties, who are expected to plead that FERC violated the Federal Power Act when including a market pathway for distribution-connected electric storage resources. ESA seeks to ensure that all storage resources are able to participate in wholesale markets and provide the full flexibility they are capable of to the electric system. ESA also notes our intention to coordinate briefs with AEE and SEIA.
